Terms of Us

Welcome to Highbury Gaming Experience (“Highbury”, “we”, “us”, or “our”).These Terms of Use (“Terms”) govern your access to and use of our physical premises located opposite Utawala along Eastern Bypass Road, Nairobi, Kenya, as well as any associated services, including gaming sessions, VR experiences, esports training, tournaments, VR Learning Lab classes, merchandise purchases, bookings, and participation in events (collectively, the “Services”).

By entering our premises, using our equipment, booking services, purchasing merchandise, or participating in any activity at Highbury, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Eligibility

  • You must be at least 8 years old to use our Services.

  • Users under 18 must have parental or guardian consent and supervision where required (especially for VR sessions and tournaments).

  • Parents/guardians are responsible for the actions of minors under their care.

2. Booking & Payment

  • All bookings (gaming sessions, VR experiences, classes, tournaments, parties, etc.) are subject to availability and confirmation.

  • Payment must be completed in full at the time of booking or upon arrival (via cash, M-Pesa, or card).

  • Prices are in Kenyan Shillings (KES) and inclusive of applicable taxes unless stated otherwise.

  • We reserve the right to refuse service or cancel bookings without refund if these Terms are violated.

3. Conduct & House Rules

You agree to:

  • Treat all staff, customers, and property with respect.

  • Follow instructions from Highbury staff at all times.

  • Not engage in cheating, harassment, discrimination, or disruptive behaviour.

  • Not bring food, drinks, alcohol, drugs, or weapons onto the premises (except sealed water bottles).

  • Not smoke or vape inside or near entrances.

  • Keep the premises clean and report any damage immediately.

Violations may result in immediate removal, session termination without refund, and/or permanent ban.

4. Health & Safety – VR Specific

  • VR use may cause motion sickness, dizziness, or discomfort. Stop immediately if you feel unwell.

  • Users with epilepsy, heart conditions, pregnancy, or other health concerns should consult a doctor before VR use.

  • Maximum recommended VR session: 60 minutes with breaks.

  • Guardians must supervise children during VR experiences.

  • Highbury is not liable for any health issues arising from VR use.

5. Equipment & Property

  • You are responsible for any damage to PS5 consoles, VR headsets, controllers, chairs, TVs, or other equipment caused by misuse or negligence. Replacement/repair costs will be charged.

  • Personal belongings are your responsibility. Highbury is not liable for loss, theft, or damage.

6. Photography, Video & Social Media

  • Highbury may photograph or record events, sessions, and tournaments for promotional purposes. By attending, you grant us permission to use your likeness without compensation.

  • Personal recording is allowed for non-commercial use only, provided it does not disrupt others.

7. Merchandise

  • All sales are final. No refunds or exchanges except for manufacturing defects (within 7 days with receipt).

  • We reserve the right to limit quantities or cancel orders.

8. Liability Waiver

  • You use our Services at your own risk. Highbury is not liable for injuries, losses, or damages except where caused by our gross negligence.

  • You agree to indemnify Highbury against claims arising from your actions or violations of these Terms.

9. Cancellation & Refund Policy

  • Bookings cancelled >24 hours in advance: full refund or reschedule.

  • <24 hours or no-show: no refund.

  • Tournaments: entry fees non-refundable once bracket is confirmed.

  • We may cancel or reschedule Services due to technical issues, low attendance, or force majeure (no liability for refunds beyond fees paid).

10. Privacy

Your personal data (name, phone, email, child details for classes) is collected for operational purposes and protected under Kenyan data protection laws. See our Privacy Policy for details.

11. Changes to Terms

We may update these Terms at any time. Continued use of Services after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Kenya. Disputes shall be resolved in Nairobi courts.
